CND Life Sciences, Inc. (“CND” or “we”) offers health care providers, and other clients, access to informational and educational resources, including training programs, in connection with skin biopsy procedures for human sample collection required to perform CND’s proprietary testing services, such as the Syn-One Test and Small-Fiber Dx. Conducted by members of CND’s sales and/or Clinical Services teams, these programs are designed to demonstrate only how to perform the biopsy procedure and proper sample collection and storage methods, and any instructions provided are based on prior clinical use, research, and/or the individual experience of the instructor. No portion of these training programs, or any other instructional or educational resources made available by CND, should be relied on, or confused, as medical advice or consultation.
Clients who participate in and satisfactorily complete a CND training program may be recognized as a Level 1, 2, or 3 “CND-certified” provider, depending on the program completed. The levels of training and provider designations are as follows:
- Level 1: Providers, and other clients, are eligible to be designated as “CND-certified: Biopsy Procedure, Level 1,” upon certifying to CND that they have received and reviewed (1) CND’s biopsy procedure guide; and (2) an animated video, demonstrating how to use the applicable CND Skin Biopsy Kit.
- Level 2: Providers, and other clients, are eligible to be designated as “CND-certified: Biopsy Procedure, Level 2,” upon attending a virtual presentation, conducted by a member of CND’s Sales and/or Clinical Services team, via videoconference, demonstrating how to use the applicable CND Skin Biopsy Kit.*.
- Level 3: Providers, and other clients, are eligible to be designated as “CND-certified: Biopsy Procedure, Level 3,” upon participating in an in-person biopsy demonstration, conducted by a member of CND’s Sales and/or Clinical Services team, demonstrating how to use the applicable CND Skin Biopsy Kit.*.
“CND-certified” providers, of any level, may advertise this designation to the public, but may not misrepresent the meaning or import of such designation, which denotes only that a provider has participated in, and satisfactorily completed, a training program offered by CND as a demonstration. CND reserves the right to revoke a provider’s “CND-certified” designation, at any time, with or without notice, upon determining, in CND’s sole discretion, that the provider is (1) no longer eligible for such designation, due to the provider’s egregious and/or repeated errors in using CND’s products or services; or (2) misrepresenting the meaning or import of his or her designation as a “CND-certified” provider.
For the avoidance of doubt, designation as a “CND-certified” provider, regardless of level, DOES NOT represent a representation, warranty, or opinion by CND regarding any provider’s ability to practice a medical profession, perform a particular procedure, or achieve any particular results. CND is in no way responsible for credentialing or training in medical procedures or techniques, nor are the training programs provided by CND a replacement for hospital or professional society credentialing requirements. The provider who performs any medical procedure is responsible for determining and using the appropriate techniques for such procedure with each individual patient, based on the patient’s particular characteristics and on the provider’s independent clinical judgment, knowledge, and education.
CND does not make any warranties about the completeness, reliability, or accuracy of information provided during the training programs, or in any other informational or educational resources we make available. Any action a provider takes in reliance on such information is strictly at his or her own risk. Neither CND nor any instructor is responsible or liable for any advice, procedure, course of treatment, diagnosis, or any other medical or treatment decision the provider makes, even if based on information obtained through CND’s educational or informational resources, and CND will not be liable for any losses and/or damages in connection with the use of such resources, including, without limitation, any resources on CND’s website (www.cndlifesciences.com).
(*Demonstrations will be performed on non-human “specimens” (e.g., an orange) only. Under no circumstances will CND, or any of its personnel, perform a demonstration on a human.)
